Google accusé de ne pas proposer des résultats loyaux sur son moteur
En s’appuyant sur trois plaintes de sociétés Internet, le procureur général de l’Etat du Texas accuse Google de ne pas afficher des résultats honnêtes sur son moteur.
Au Texas, la justice locale accuse Google d’afficher des pages biaisées de résultats de recherches lorsque que l’on tape une requête.
C’est le procureur général de cet Etat qui se charge de l’enquête sur le caractère « honnête » du système de ranking (classement) sur le moteur exploité par le groupe Internet.
Selon Google, trois sociétés plaignantes se sont manifestées : Foundem (moteur vertical), TradeComet (qui édite le moteur de recherche BtoB SourceTool.com) et myTriggers (moteur shopping).
Ils se considèrent comme des rivaux de Google dans le domaine du search.
La thèse du complot n’est pas loin d’être formulée. Selon Reuters, Google souligne pour sa défense le fait que les avocats de deux sociétés à l’origine de la plainte travaillent également pour le compte de…Microsoft.
Pour certains plaignants, ce n’est pas un coup d’essai.
Ainsi, en 2009, TradeComet avait initié une action anti-trust contre Google en lien avec la gestion de son programme de liens sponsorisés (AdWords).
Mais la justice avait conclu à l’époque à un non-lieu.
De l’autre côté de l’Atlantique, des inquiétudes commencent à poindre. Google fait également l’objet de griefs similaires en Europe.
Ainsi, en février dernier, la Commission européenne a accepté d’examiner les plaintes de trois sociétés Internet implantées sur le Vieux continent : Foundem, eJustice.fr (portail juridique) et Ciao (guide shopping).
Elles accusent Google de fausser la présentation des pages de résultats ou celle d’AdWords.

| Toujours aux Etats-Unis, Google a réglé à l’amiable un autre litige portant sur les manquements à la vie privée lors du lancement de son réseau social Google Buzz. Le groupe Internet a accepté de verser 8,5 millions de dollars à la justice, à un utilisateur de sa messagerie Gmail et à des organisations de défense de la vie privée pour mettre un terme aux poursuites engagées. Les dépôts des plaintes avaient été initialement déposées devant un tribunal de district de Californie à compétence fédérale (U.S. District Court, Northern District of California). |
