Face à la pression du gouvernement, Free va céder à l’Hadopi. Xavier Niel, le fondateur d’Iliad, la maison-mère du FAI, a confirmé au quotidien Les Echos que Free allait commencer à envoyer dès ce lundi les premiers e-mails d’avertissement à ses abonnés soupçonnés de téléchargement illégal.
Menacé de sanctions financières en cas de refus répété d’envoyer ces messages de « recommandations », l’opérateur a donc décidé d’appliquer le décret publié ce 12 octobre émanant du ministère de la Justice et du ministère de la Culture.
Celui-ci stipule que « les opérateurs sont tenus d’adresser par voie électronique à l’abonné chacune des recommandations mentionnées respectivement au premier et au deuxième alinéa de l’article L. 331-25, dans un délai de vingt-quatre heures suivant sa transmission par la commission de protection des droits [rattachée à l'Hadopi, NDLR].”
En cas de non application de ce décret, les FAI contrevenants encourent une contravention de 1 500 euros.
Toutefois, Xavier Niel souligne qu’il juge ce nouveau décret « illégal ».
« Contrairement aux autres FAI, nous appliquerons strictement la loi, mais seulement la loi. Notre position n’était ni marketing, ni financière. Nous n’avons pas gagné un abonné en refusant de collaborer au-delà de ce nous imposent les textes […]« ,a-t-il affirmé aux Echos. « Cette loi est une mauvaise loi qui ne résout rien, qui est très simplement contournable […]« .
Début octobre, les FAI avaient commencé à envoyer à leurs abonnés les premiers e-mails d’avertissements voulus par l’Hadopi. Sauf Free.
Pour justifier son refus de faire suivre les e-mails de l’Hadopi à ses abonnés, Free avait alors expliqué avoir proposé le “principe d’un conventionnement dans le courant de l’été au Ministère de la Culture et à l’Hadopi. A ce jour nous n’avons eu aucun retour concret sur cette étape structurante pour le passage en production.”
En tous les cas, la Haute autorité pour la diffusion des œuvres et la protection des droits sur Internet ne chôme pas. Selon la page Facebook du Sénat, quelques sénateurs confirment que 800 e-mails d’avertissement ont été expédiés début octobre, lors de la première salve d’envois par les opérateurs.
