French Data Network ne parvient pas à s’opposer à la mise en place de la Hadopi à travers ses recours devant le Conseil d’Etat.
Un des trois recours (celui en référé, sachant qu’il en existe deux autres en vue d’un examen sur le fond) vient d’être rejeté par la plus haute instance administrative de France.
Selon l’AFP qui cite un extrait de l’ordonnance rendue, « aucun des moyens invoqués par l’association requérante n’est de nature à faire naître, en l’état de l’instruction, un doute sérieux sur la légalité du décret dont elle demande la suspension. »
Dans ses saisines, FDN exploite des failles présumées dans des décrets relatifs à la procédure Hadopi pour sanctionner les internautes soupçonnés de téléchargement illégal et à la mise en œuvre de la loi inhérente.
Le fournisseur d’accès Internet alternatif (une association loi 1901 en fait) considère notamment que l’ARCEP devrait être consultée à propos des relations entre les organismes des ayant droits, la Haute Autorité pour la diffusion des œuvres et la protection des droits sur Internet, et les opérateurs télécoms.
Mais le Conseil d’Etat a rejeté ses arguments de FDN visant à suspendre le dispositif de lutte contre le téléchargement illégal de musique sur Internet.

Hadopi me parait de plus en plus absurde, quand on voit tout les moyens qui existe pour contourner la loi légalement comme les VPN.
