La marque Hadopi a d’abord été déposée par un particulier
Renaud Veeckman a déposé en mai dernier la marque Hadopi auprès de l’INPI, prenant ainsi une longueur d’avance sur le gouvernement. Mais l’INPI n’a pas encore validé sa demande.
Deuxième cafouillage en vue dans le cadre de la mise en place de l’Hadopi (Haute autorité pour la diffusion des œuvres et la protection des droits sur Internet). Ce n’est pas l’Etat qui a déposé en premier ce nom de marque auprès de l’INPI, l’Institut National de la Propriété Industrielle.
Cet acronyme avait déjà été déposé le 19 mai dernier par un certain Renaud Veeckman, habitant Avignon (Vaucluse), sous le numéro 3651652. Interrogé par l’AFP, Renaud Veeckman a précisé qu’il comptait utiliser ce nom d’ « Hadopi » pour nommer sa future… plate-forme de téléchargement musical. Drôle de coïncidence…
Mais l’Avignonnais a expliqué à l’agence de presse qu’il n’avait « jamais pensé que l’Etat déposerait cette marque ».
De son côté, le ministère de la Culture et de la Communication a aussi déposé auprès de l’INPI, le 16 novembre 2009, la marque Hadopi, suivie de sa signification : Haute autorité pour la diffusion des œuvres et la protection des droits sur Internet.
Déjà, en début de semaine, la première version du logo de l’Hadopi avait attiré l’œil. En effet, la typographie employée, connue sous le nom de « Bienvenue » a été créée par Jean-François Porchez, et est détenue en exclusivité depuis dix ans par France Telecom…
Si pour l’instant les deux demandes de dépôt concernant cette appellation ont été publiées dans le bulletin officiel de l’Institut National de la Propriété Industrielle, aucune n’a encore été officiellement validée et enregistrée par l’INPI.
Toutefois, la célérité de Renaud Veeckman risque de ne pas payer. L’INPI a en effet expliqué à l’AFP que sa demande avait peu de chance d’aboutir, car elle ne correspondrait pas « aux critères requis ».
Pour obtenir enfin officiellement le droit d’exploiter la marque Hadopi, l’Etat pourrait faire valoir que ce terme est déjà utilisé publiquement par le gouvernement depuis plusieurs mois, et ainsi mettre en avant la notoriété affichée de cet acronyme, et le fait qu’il désigne une organisation officielle.
